Introductory provisions<\/b><\/h2><p><span style=\"font-weight: 400;\">These Terms &amp; Conditions apply to all agreements entered into with The Away Experience. By booking an experience, you accept these Terms &amp; Conditions in full.<\/span><\/p><p><span style=\"font-weight: 400;\">The Away Experience is operated by:<\/span><\/p><p><span style=\"font-weight: 400;\">The Away Experience (a brand of VengaBarcelona)<\/span><\/p><p><span style=\"font-weight: 400;\">Carrer de Mallorca 496 Sat | 08013 Barcelona | Spain<\/span><\/p><p><span style=\"font-weight: 400;\">Phone: +34 663 677 339<\/span><\/p><p><span style=\"font-weight: 400;\">Email: info@theawayexperience.com<\/span><\/p><p><span style=\"font-weight: 400;\">Website: www.theawayexperience.com<\/span><\/p><p><span style=\"font-weight: 400;\">In these Terms &amp; Conditions, the following definitions apply:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">&#8220;Experience&#8221; or &#8220;Tour&#8221;: any guided activity offered by The Away Experience, including (but not limited to) walking tours, bike tours, matchday experiences, academy visits and custom tour packages.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">&#8220;Booking&#8221; or &#8220;Agreement&#8221;: the agreement between The Away Experience and the Customer for the provision of one or more Experiences.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">&#8220;Customer&#8221; or &#8220;Participant&#8221;: the person who books the Experience and any additional persons on whose behalf the booking is made.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">&#8220;Booking Fee&#8221; or &#8220;Price&#8221;: the total amount due for the Experience(s), including any applicable taxes.<\/span><\/li><\/ul><h2><b>Article 2. Information from The Away Experience<\/b><\/h2><p><b>2.1\u00a0 <\/b><span style=\"font-weight: 400;\">The Away Experience is not responsible for general information shown in photographs, brochures, advertisements, websites or other information sources if such material has been produced or published by third parties.<\/span><\/p><p><b>2.2\u00a0 <\/b><span style=\"font-weight: 400;\">Obvious errors or mistakes in pricing, descriptions or scheduling do not bind The Away Experience.<\/span><\/p><p><b>2.3\u00a0 <\/b><span style=\"font-weight: 400;\">Tour itineraries, meeting points and timings are indicative. Routes may be adjusted by the guide on the day for safety, weather, or unforeseen circumstances.<\/span><\/p><h2><b>Article 3. Information from the Customer<\/b><\/h2><p><b>3.1\u00a0 <\/b><span style=\"font-weight: 400;\">The Customer provides The Away Experience, prior to the conclusion of the Booking, with all information about themselves and other Participants that may be relevant for the conclusion or execution of the Agreement.<\/span><\/p><p><b>3.2\u00a0 <\/b><span style=\"font-weight: 400;\">The Customer discloses any details about the personal health and physical or mental condition of themselves and other Participants that may be relevant for the safe and proper execution of the Experience. This includes but is not limited to: cycling ability for bike tours, mobility limitations, allergies, and any medical conditions that may affect participation.<\/span><\/p><p><b>3.3\u00a0 <\/b><span style=\"font-weight: 400;\">If the Customer fails in this duty to inform, this may result in The Away Experience excluding the Customer or other Participants from (further) participation. In such cases, all costs incurred will be charged to the Customer and no refund will be issued.<\/span><\/p><p><b>3.4\u00a0 <\/b><span style=\"font-weight: 400;\">The Experience offering may, on request, be modified by The Away Experience for medical or other reasons. If costs are involved, these will be communicated to the Customer in advance.<\/span><\/p><h2><b>Article 4. The Away Experience&#8217;s right to refuse or terminate<\/b><\/h2><p><span style=\"font-weight: 400;\">The Away Experience reserves the right to decline a Booking, before or after confirmation, without stating reasons, if there are facts or circumstances regarding the Customer that raise reasonable concerns about the physical or mental fitness of the Customer to participate safely. In such case, The Away Experience will refund any amount already received from the Customer, less any non-refundable costs already incurred with third parties.<\/span><\/p><h2><b>Article 5. Price and payment<\/b><\/h2><p><b>5.1\u00a0 <\/b><span style=\"font-weight: 400;\">Prices and discounts shown by The Away Experience are those valid on the day the Booking is made, unless otherwise agreed in writing.<\/span><\/p><p><b>5.2\u00a0 <\/b><span style=\"font-weight: 400;\">All prices are stated in euros (\u20ac) and include applicable Spanish taxes (IVA), unless explicitly stated otherwise.<\/span><\/p><p><b>5.3\u00a0 <\/b><span style=\"font-weight: 400;\">For standard Experiences (walking tours, bike tours, academy visits), full payment is due at the time of booking confirmation, unless otherwise agreed in writing.<\/span><\/p><p><b>5.4\u00a0 <\/b><span style=\"font-weight: 400;\">For matchday experiences and custom multi-component packages where match tickets are included, The Away Experience may require an immediate non-refundable deposit equal to the cost of the match ticket(s), with the remaining balance due no later than 14 days before the Experience date.<\/span><\/p><p><b>5.5\u00a0 <\/b><span style=\"font-weight: 400;\">Invoices issued by The Away Experience must be paid within 14 days of the invoice date, or sooner if so indicated by The Away Experience, by the payment method provided. No right of discount or set-off applies.<\/span><\/p><p><b>5.6\u00a0 <\/b><span style=\"font-weight: 400;\">All costs related to payment, including any cost of providing security or processing fees imposed by payment providers, are at the expense of the Customer.<\/span><\/p><p><b>5.7\u00a0 <\/b><span style=\"font-weight: 400;\">After the payment deadline has passed, the Customer is automatically in default without further notice required, and the Booking is considered cancelled. The Away Experience reserves the right to claim the full agreed Price.<\/span><\/p><p><b>5.8\u00a0 <\/b><span style=\"font-weight: 400;\">The Away Experience is entitled to suspend the provision of services as soon as the Customer is in default of any payment obligation.<\/span><\/p><p><b>5.9\u00a0 <\/b><span style=\"font-weight: 400;\">If the Customer remains in default, The Away Experience may transfer the claim for collection. The Customer will then also be liable for all extrajudicial and judicial collection costs, with a minimum of \u20ac40 and calculated according to applicable Spanish law.<\/span><\/p><p><b>5.10\u00a0 <\/b><span style=\"font-weight: 400;\">Disputes about an invoice must be communicated in writing within 5 working days of the invoice date, failing which the right to dispute lapses.<\/span><\/p><p><b>5.11\u00a0 Additional costs. <\/b><span style=\"font-weight: 400;\">Any additional expenses incurred by the Customer during an Experience that are not part of the booked services (such as food and drink not included, optional add-ons, transport not part of the tour) must be settled directly by the Customer with the relevant service provider. The Away Experience is not responsible or liable for these costs.<\/span><\/p><h2><b>Article 6. Substitution of participants<\/b><\/h2><p><b>6.1\u00a0 <\/b><span style=\"font-weight: 400;\">If a Participant is unable to attend, the Customer may transfer the booking to another person, subject to the conditions in 6.2.<\/span><\/p><p><b>6.2\u00a0 <\/b><span style=\"font-weight: 400;\">The conditions for substitution are:<\/span><\/p><p><b>(a) <\/b><span style=\"font-weight: 400;\">the substitute meets all conditions of the Experience;<\/span><\/p><p><b>(b) <\/b><span style=\"font-weight: 400;\">the substitution request is made at least 48 hours before the start of the Experience, or sufficiently in advance for The Away Experience to process the change;<\/span><\/p><p><b>(c) <\/b><span style=\"font-weight: 400;\">the conditions of any third parties involved (e.g. clubs, ticket providers) do not preclude substitution. Match tickets, in particular, may be non-transferable;<\/span><\/p><p><b>(d) <\/b><span style=\"font-weight: 400;\">any additional costs arising from the substitution are paid in full to The Away Experience before the start of the Experience.<\/span><\/p><h2><b>Article 7. Provision of services<\/b><\/h2><p><b>7.1\u00a0 <\/b><span style=\"font-weight: 400;\">The Away Experience is only obliged to perform its obligations after full payment has been received from the Customer, unless explicitly agreed otherwise in writing.<\/span><\/p><p><b>7.2\u00a0 <\/b><span style=\"font-weight: 400;\">The Away Experience commits to a duty of effort, not a duty of result, with regard to all assignments. We do our utmost to deliver the Experience as described, but cannot guarantee specific outcomes.<\/span><\/p><p><b>7.3\u00a0 <\/b><span style=\"font-weight: 400;\">All timings, durations and schedules referenced are best-effort estimates. Slight deviations do not constitute default, but The Away Experience will always seek to deliver the Experience in full to the benefit of the Customer.<\/span><\/p><p><b>7.4\u00a0 <\/b><span style=\"font-weight: 400;\">The Customer ensures that all information that The Away Experience indicates is necessary, or that the Customer should reasonably understand to be necessary, for the proper performance of the Experience is provided in good time. If such information is not provided in time, The Away Experience may suspend the Experience and\/or charge any extra costs arising from the delay.<\/span><\/p><p><b>7.5\u00a0 <\/b><span style=\"font-weight: 400;\">The Customer is required to arrive at the meeting point on time. If the Customer arrives late, the guide is not obliged to wait, and time lost will not be compensated. After 15 minutes past the scheduled start time, the Experience may be considered forfeited without right to refund.<\/span><\/p><h2><b>Article 8. Engagement of third parties<\/b><\/h2><p><b>8.1\u00a0 <\/b><span style=\"font-weight: 400;\">The Away Experience is at all times free to engage third parties for the execution of the booked services (for example, but not limited to: bike rental providers, ticket vendors, transport operators, freelance guides).<\/span><\/p><p><b>8.2\u00a0 <\/b><span style=\"font-weight: 400;\">The Away Experience will exercise due care when engaging third parties. However, The Away Experience is not liable for damage resulting from shortcomings of third parties. The Away Experience accepts, where necessary on behalf of the Customer, any liability limitations of such third parties.<\/span><\/p><p><b>8.3\u00a0 <\/b><span style=\"font-weight: 400;\">By booking, the Customer acknowledges that third parties (including football clubs, transport providers and ticket vendors) reserve the right to make changes to schedules, fixtures or services. In the event of such changes that are not attributable to either party but result in additional costs, each party bears its own costs and damages.<\/span><\/p><h2><b>Article 9. Liability and indemnification<\/b><\/h2><p><b>9.1\u00a0 <\/b><span style=\"font-weight: 400;\">The Away Experience&#8217;s liability for indirect damage, consequential damage, lost profits, damage resulting from third-party claims against the Customer, damage from exceeding deadlines, or property damage is excluded, except in cases of intent or gross negligence on the part of The Away Experience.<\/span><\/p><p><b>9.2\u00a0 <\/b><span style=\"font-weight: 400;\">The Away Experience is not liable for damage of any kind arising from incorrect or incomplete information provided by the Customer, unless such inaccuracy was or should have been recognisable to The Away Experience. The Customer must verify the accuracy of any booking documentation within 24 hours of receipt.<\/span><\/p><p><b>9.3\u00a0 <\/b><span style=\"font-weight: 400;\">The total liability of The Away Experience is limited to the Price paid for the relevant Experience, or the amount paid out by The Away Experience&#8217;s liability insurer for the case in question, whichever is lower.<\/span><\/p><p><b>9.4\u00a0 <\/b><span style=\"font-weight: 400;\">Any liability claim against The Away Experience only arises if the Customer notifies The Away Experience in writing of the alleged damage within 7 days of becoming aware of it, with a clear and detailed description of the shortcoming, and offers a reasonable period to remedy it.<\/span><\/p><p><b>9.5\u00a0 <\/b><span style=\"font-weight: 400;\">The Customer indemnifies The Away Experience and its staff against all third-party claims, including reasonable legal costs, that relate in any way to the services provided by The Away Experience, except in cases of intent or gross negligence on the part of The Away Experience.<\/span><\/p><p><b>9.6\u00a0 <\/b><span style=\"font-weight: 400;\">The Customer is required to follow all instructions given by or on behalf of The Away Experience and its engaged third parties. The Customer is liable for damage caused by their own conduct or that of other Participants under their booking.<\/span><\/p><p><b>9.7\u00a0 <\/b><span style=\"font-weight: 400;\">If a Participant causes such nuisance or disruption that further participation can no longer reasonably be expected, The Away Experience and its engaged third parties are entitled to exclude one or more Participants from further services. The Customer indemnifies The Away Experience against any costs arising from such exclusion, and no refund will be issued.<\/span><\/p><p><b>9.8\u00a0 Bike tours and physical activities. <\/b><span style=\"font-weight: 400;\">Participants take part in bike tours and other physical activities at their own risk. The Customer ensures they are physically fit for the activity. Any traffic fines incurred while not following the guide&#8217;s instructions are at the Participant&#8217;s own expense. Participants must be sober and in good health when joining any activity. The Away Experience strongly recommends that all Participants carry their own personal travel and accident insurance.<\/span><\/p><p><b>9.9\u00a0 Match tickets and football matches. <\/b><span style=\"font-weight: 400;\">For matchday experiences, The Away Experience acts as a reseller of match tickets. The Away Experience is not responsible for: changes to match dates or kick-off times made by the football club or league; the result of the match; the behaviour of other spectators; stadium security procedures; or any restrictions on entry imposed by the venue. Where a match is rescheduled by the club, The Away Experience will use reasonable efforts to honour the booking on the new date, but cannot guarantee availability.<\/span><\/p><p><b>9.10\u00a0 Personal belongings. <\/b><span style=\"font-weight: 400;\">The Away Experience is not liable for loss, theft, or damage to personal belongings of Participants during an Experience, including (but not limited to) cameras, phones, bags and clothing.<\/span><\/p><h2><b>Article 10. Force majeure<\/b><\/h2><p><b>10.1\u00a0 <\/b><span style=\"font-weight: 400;\">If The Away Experience is unable to fulfil its obligations to the Customer due to a non-attributable shortcoming (force majeure), those obligations are suspended for the duration of the force majeure situation.<\/span><\/p><p><b>10.2\u00a0 <\/b><span style=\"font-weight: 400;\">Force majeure is understood to include, without limitation:<\/span><\/p><p><b>(a) <\/b><span style=\"font-weight: 400;\">riots, wars, blockades, threats, sabotage, civil unrest or terrorism;<\/span><\/p><p><b>(b) <\/b><span style=\"font-weight: 400;\">earthquakes, floods, fires, extreme weather, storms, lightning or other natural disasters;<\/span><\/p><p><b>(c) <\/b><span style=\"font-weight: 400;\">radioactive contamination, epidemics, pandemics or other regional or national public health events; chemical, ecological or biological hazards;<\/span><\/p><p><b>(d) <\/b><span style=\"font-weight: 400;\">strikes or labour disputes affecting the Experience or its supply chain;<\/span><\/p><p><b>(e) <\/b><span style=\"font-weight: 400;\">government sanctions, embargoes, mandates, decrees, policy decisions or laws that prevent or substantially limit performance;<\/span><\/p><p><b>(f) <\/b><span style=\"font-weight: 400;\">failures of suppliers or third parties engaged by The Away Experience, including (but not limited to) ticket providers and transport operators;<\/span><\/p><p><b>(g) <\/b><span style=\"font-weight: 400;\">rescheduling, cancellation or postponement of football matches by the relevant club, league or competition organiser;<\/span><\/p><p><b>(h) <\/b><span style=\"font-weight: 400;\">extreme weather conditions that make the safe execution of an outdoor Experience impossible.<\/span><\/p><p><b>10.3\u00a0 <\/b><span style=\"font-weight: 400;\">Where force majeure prevents only part of the Experience from being delivered, the Customer remains obliged to pay for the parts that have been delivered. The Away Experience will refund the part of the Price relating to undelivered services, less any non-refundable costs already paid to third parties.<\/span><\/p><p><b>10.4\u00a0 <\/b><span style=\"font-weight: 400;\">Where a force majeure situation continues for more than 14 days, both parties are entitled to terminate the Agreement in writing. Services already delivered are settled proportionally without further claim by either party.<\/span><\/p><p><b>10.5\u00a0 <\/b><span style=\"font-weight: 400;\">Light rain or weather that does not endanger safety is not, by itself, considered force majeure. Walking and bike tours generally proceed as planned in light rain. Participants are advised to dress for the weather.<\/span><\/p><h2><b>Article 11. Cancellation by the Customer<\/b><\/h2><p><b>11.1\u00a0 <\/b><span style=\"font-weight: 400;\">The Customer may cancel the Booking at any time by giving written notice to The Away Experience by email at info@theawayexperience.com.<\/span><\/p><p><b>11.2\u00a0 <\/b><span style=\"font-weight: 400;\">If the Customer cancels for reasons attributable to them, the following cancellation fees apply for standard Experiences (walking tours, bike tours, academy visits) where no match ticket is included:<\/span><\/p><p><b>(a) <\/b><span style=\"font-weight: 400;\">more than 14 days before the Experience: full refund, less a 5% administration fee;<\/span><\/p><p><b>(b) <\/b><span style=\"font-weight: 400;\">between 14 and 7 days before the Experience: 50% of the Price is non-refundable;<\/span><\/p><p><b>(c) <\/b><span style=\"font-weight: 400;\">between 7 days and 48 hours before the Experience: 75% of the Price is non-refundable;<\/span><\/p><p><b>(d) <\/b><span style=\"font-weight: 400;\">less than 48 hours before the Experience, or no-show: 100% of the Price is non-refundable.<\/span><\/p><p><b>11.3\u00a0 <\/b><span style=\"font-weight: 400;\">For Experiences that include match tickets (matchday experiences and packages), the following applies:<\/span><\/p><p><b>(a) <\/b><span style=\"font-weight: 400;\">the cost of the match ticket itself is non-refundable from the moment of booking, regardless of when the cancellation is made;<\/span><\/p><p><b>(b) <\/b><span style=\"font-weight: 400;\">for the remainder of the Price (guiding, transport, etc.), the cancellation tiers in Article 11.2 apply;<\/span><\/p><p><b>(c) <\/b><span style=\"font-weight: 400;\">where the football match itself is rescheduled by the club, see Article 10.2(g) and Article 9.9.<\/span><\/p><p><b>11.4\u00a0 <\/b><span style=\"font-weight: 400;\">The Away Experience may, at its sole discretion, offer the Customer the option to reschedule rather than cancel, subject to availability and any cost differences with the new date. This is a courtesy and not a right.<\/span><\/p><h2><b>Article 12. Termination<\/b><\/h2><p><b>12.1\u00a0 <\/b><span style=\"font-weight: 400;\">Either party is entitled to terminate the Agreement only if the other party, after a proper and detailed written notice of default with a reasonable period to remedy the shortcoming, remains in attributable breach of material obligations.<\/span><\/p><p><b>12.2\u00a0 <\/b><span style=\"font-weight: 400;\">The Away Experience may terminate the Agreement in whole or in part by written notice, without further notice of default and without judicial intervention, if the Customer:<\/span><\/p><p><b>(a) <\/b><span style=\"font-weight: 400;\">fails to meet payment obligations;<\/span><\/p><p><b>(b) <\/b><span style=\"font-weight: 400;\">is granted suspension of payments, whether provisional or final;<\/span><\/p><p><b>(c) <\/b><span style=\"font-weight: 400;\">is the subject of a bankruptcy petition or whose business is liquidated or wound up. In such cases, The Away Experience is not obliged to pay any compensation.<\/span><\/p><p><b>12.3\u00a0 <\/b><span style=\"font-weight: 400;\">Services already delivered, and the related payment obligations, are not undone by termination unless The Away Experience is in material default in respect of those services. Amounts invoiced before termination remain payable in full and become immediately due.<\/span><\/p><p><b>12.4\u00a0 <\/b><span style=\"font-weight: 400;\">In the event of nullity of one or more provisions of these Terms &amp; Conditions, the parties will consult to agree on replacement provisions that approximate the purpose and intent of the void provisions as closely as possible. The remaining provisions remain in full force.<\/span><\/p><h2><b>Article 13. Transfer of rights<\/b><\/h2><p><span style=\"font-weight: 400;\">Without the prior written consent of The Away Experience, the Customer is not permitted to transfer rights or obligations arising from the Agreement, in whole or in part, to third parties, nor to have third parties perform such obligations on their behalf.<\/span><\/p><h2><b>Article 14. Help and assistance<\/b><\/h2><p><b>14.1\u00a0 <\/b><span style=\"font-weight: 400;\">Depending on the circumstances, The Away Experience is obliged to provide the Customer with reasonable help and assistance if the Experience does not proceed in line with the expectations the Customer could reasonably have formed on the basis of the Agreement.<\/span><\/p><p><b>14.2\u00a0 <\/b><span style=\"font-weight: 400;\">If the cause of these circumstances is attributable to the Customer, The Away Experience is only obliged to provide help and assistance to the extent that this can reasonably be required. The cost of such help and assistance is at the expense of the Customer.<\/span><\/p><h2><b>Article 15. Consent to use of photographic and video material<\/b><\/h2><p><b>15.1\u00a0 <\/b><span style=\"font-weight: 400;\">The Away Experience regularly takes photos and videos of Experiences for use on social media (such as Instagram, Facebook, TikTok), on its website, and in editorial or promotional content. This material helps potential future Customers understand what an Experience is like and supports the marketing of the business.<\/span><\/p><p><b>15.2\u00a0 <\/b><span style=\"font-weight: 400;\">By accepting these Terms &amp; Conditions, the Customer grants The Away Experience permission, on behalf of all Participants in the booking, to publish photos and videos in which they may be identifiable on the platforms referenced in 15.1. For Participants under the age of 16, no images may be published without prior written consent of a parent or legal guardian.<\/span><\/p><p><b>15.3\u00a0 <\/b><span style=\"font-weight: 400;\">The Customer has the right to withdraw this consent at any time, with effect from the moment of withdrawal. To withdraw consent or to request the removal of specific images, send an email to info@theawayexperience.com.<\/span><\/p><p><b>15.4\u00a0 <\/b><span style=\"font-weight: 400;\">On the day of the Experience, Participants who do not wish to be photographed or filmed may inform the guide, and the guide will avoid including them in posed shots or close-up imagery where possible.<\/span><\/p><h2><b>Article 16. Travel documents and personal responsibility<\/b><\/h2><p><b>16.1\u00a0 <\/b><span style=\"font-weight: 400;\">The Customer and other Participants are themselves responsible for holding valid travel documents (passport, ID, residence permit, visa where applicable) for the duration of their stay in Spain. The Away Experience does not arrange flights, accommodation, or border-crossing logistics for standard Experiences.<\/span><\/p><p><b>16.2\u00a0 <\/b><span style=\"font-weight: 400;\">If a Participant is unable to attend the Experience due to the absence of any valid document, all costs arising from this are at the expense of the Customer, and standard cancellation terms (Article 11) apply.<\/span><\/p><p><b>16.3\u00a0 <\/b><span style=\"font-weight: 400;\">The Away Experience is not liable for the loss, damage or theft of personal documents during an Experience.<\/span><\/p><h2><b>Article 17. Governing law and jurisdiction<\/b><\/h2><p><b>17.1\u00a0 <\/b><span style=\"font-weight: 400;\">These Terms &amp; Conditions and any Agreement between The Away Experience and the Customer are governed by Spanish law.<\/span><\/p><p><b>17.2\u00a0 <\/b><span style=\"font-weight: 400;\">Any dispute that the parties cannot resolve amicably will be submitted to the competent court of Barcelona, Spain.<\/span><\/p><p><b>17.3\u00a0 <\/b><span style=\"font-weight: 400;\">Where the Customer is a consumer resident in another country of the European Union, mandatory consumer protection rules of that country may apply alongside Spanish law.<\/span><\/p><h2><b>Article 18.
